This is an online yoga and meditation training designed for people who want to practice yoga at home.
In consideration of the risk of injury while participating in any aspect of The Witchy Yoga Club Online yoga movements, classes or trainings (hereby referred to as “the Activity”), and as consideration for the right to participate in the Activity, I hereby, for myself, my heirs, executors, administrators, assigns or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive all rights, claims or causes of action of any kind whatsoever arising out of my participation in the Activity, and do hereby release and forever discharge Loella Persson, Sofia Rosenqvist, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, family members and assigns (All hereby referred to collectively as “the Team”) for any physical or psychological injury, including but not limited to illness, paralysis, death, physical harm, damages, economic or emotional loss, that I may suffer as a direct or indirect result of my participation in the Activity, including any event related to the Activity.
I am voluntarily participating in the Activity and I am participating in the Activity entirely at my own risk. I am aware of the risks associated participating in the Activity, which may include but are not limited to, physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, paralysis, economic or emotional loss, and death.
I agree to carry my own insurance as I understand that these injuries or outcomes may arise from my own while practicing the Activity.
I assume all related risks, both known to me and unknown or unlisted here, of my participation in the Activity.
I agree to indemnify and hold harmless the Team against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including but not limited to attorney's fees, hospital bills, compensation for loss of income or physical harm, if litigation arises pursuant to any claims made by me or anyone else acting on my behalf.
If any member of the Team incurs any additional expense due to my legal challenges, I agree to reimburse them personally for any costs arising from this process within 90 days of incurred expense.
I acknowledge that the Team and their directors, officers, volunteers, representatives, attorneys, family, and agents are not responsible for errors, omissions, acts of negligence or failures act of any party or entity conducting a specific event on behalf of the Team.
I acknowledge that the Activity may involve a test of my physical and mental limits, and may carry with it a potential for death, serious injury and loss. The risks may include but are not limited to those caused by strenuous exercise, flexibility training, terrain, facilities, temperature, weather, lack of hydration, condition of participants and myself, high impact exercise, high heart rate, and the actions of the Team members.
In the event that I should require medical treatment, I agree to be financially responsible for any costs incurred as the result of such treatment. I am aware and understand I should carry my own health insurance and consult with my doctor before beginning any exercise program or training. I understand that yoga, workouts and trainings, can be confrontational on the body, heart rate and may exacerbate other physical conditions.
In the event that I cause any damage to equipment or facilities, or damage to another participant or member of the Team, as a result of my willful actions, negligence or recklessness, I acknowledge and agree to be held liable for any and all costs associated with any claims that arise from said actions, negligence or recklessness.
I acknowledge that I have carefully read, understood and agree to this waiver of release, and fully understand it is a release of liability of the entire Team. I expressly agree to release and discharge the team and all of its affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors and assigns from any and all claims or causes of action and I agree to voluntarily give up or waive any right that I have to bring a legal action of any kind for any reason against any member of the Team
